Blasty
These Terms of Service ("Terms") govern your access to and use of Blasty (the "Service"), a platform for sending WhatsApp messages, managing contacts, and running AI-assisted auto-replies. By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Eligibility & accounts
You must be at least 18 years old and able to form a binding contract to use Blasty. You are responsible for keeping your login credentials and API keys secure, and for all activity that occurs under your account. Notify us immediately of any unauthorised use.
2. The Service
Blasty lets you link your own WhatsApp number(s), send individual and bulk messages, organise contacts and groups, and configure AI agents that draft and send automated replies on your behalf. The Service relies on WhatsApp, which is operated by a third party. We are not affiliated with, endorsed by, or sponsored by WhatsApp or Meta.
3. Acceptable use
You agree that you will not use Blasty to:
- Send spam, unsolicited bulk messages, or messages to recipients who have not consented to be contacted by you.
- Distribute unlawful, fraudulent, deceptive, harassing, hateful, or sexually exploitative content.
- Violate WhatsApp's or Meta's terms, policies, or commerce/business messaging rules.
- Infringe the intellectual property, privacy, or other rights of any person.
- Transmit malware, or attempt to disrupt, reverse-engineer, or gain unauthorised access to the Service.
You are solely responsible for the content of every message you send and for obtaining any consent required by applicable law (including anti-spam and data-protection laws) before contacting recipients. Misuse may lead to suspension by us or by WhatsApp, including the ban of your linked number.
4. Credits & payment
The Service is offered on a pay-as-you-go basis. Sending a message consumes credits, which you purchase in advance. Prices are shown at checkout and charged in MYR via our payment provider. Except where required by law, purchased credits are non-refundable. We may change pricing on a prospective basis; changes do not affect credits already purchased.
5. AI auto-reply
AI agents generate replies automatically based on the instructions and knowledge sources you provide. AI output may be inaccurate, incomplete, or inappropriate for a given conversation. You are responsible for reviewing agent behaviour, for the replies sent from your number, and for any consequences arising from them. We do not guarantee the accuracy or suitability of any AI-generated content.
6. Availability & changes
We aim to keep the Service running reliably but do not guarantee uninterrupted or error-free operation. Because the Service depends on WhatsApp, changes on their side may affect or interrupt functionality at any time. We may modify, suspend, or discontinue any part of the Service, and may update these Terms; continued use after changes take effect constitutes acceptance.
7. Suspension & termination
We may suspend or terminate your access if you breach these Terms, misuse the Service, or create risk or legal exposure for us. You may stop using the Service at any time. On termination, your right to use the Service ends; provisions that by their nature should survive (including payment, disclaimers, and limitation of liability) will survive.
8. Disclaimers
The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including fitness for a particular purpose, merchantability, and non-infringement, to the fullest extent permitted by law.
9. Limitation of liability
To the maximum extent permitted by law, Blasty and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill, arising from your use of the Service. Our total liability for any claim is limited to the amount you paid us for the Service in the three months before the event giving rise to the claim.
10. Governing law
These Terms are governed by the laws of Malaysia, without regard to conflict-of-law rules. The courts of Malaysia have exclusive jurisdiction over any dispute arising from these Terms or the Service.
